DEFINITION OF TERMS

1. Artist

The person creating the Commission(s) (Jars Seph or Jars).

2. Client

The person purchasing the Commission(s).

3. Commission

The form of service provided by the Artist for the Client per the Commission Form following these Terms of Service.

Commission, Art[work], and Drawing are used interchangeably throughout the legal agreements between the Artist and Client.

4. Estimated Time of Completion (ETC)

The time a commission is presumably completed, though is subject to change depending on the Artist’s circumstances.

5. Trello

A list-making application used by the Artist to inform the Client(s) on the progress of their Commission.

6. Post-Process Revisions

Revisions that require extra fee ($1 / Php 200) upon request.

GENERAL TERMS

By sending a Commission form, the Client is purchasing a Commission hereby fully agreeing with the Terms of Service below.

By agreeing to commissioning the Artist, the Client also agrees and fully consent to the Artist streaming the process through their Twitch account (https://www.twitch.tv/jars_seph) with the understanding that they have fully read and agreed with the Terms of Service below.

Standard dimensions will vary on commission type unless requested otherwise. (See Commission Types and Prices Page)

The Client must provide clear, neat descriptions and references.

The Artist has the right to refuse any Commission, without the need to explain reason(s) for doing so.

The Artist does not accept mecha, gore, and hate art.

The Artist has every right to use the commission (i.e. posting on social media and adding it in portfolios), but the finished piece may or may not be posted online with regards to the Client’s request for confidentiality.

PROCESS

The Artwork process time is subjective depending on the circumstances of the Artist. Only an Estimated Time of Completion will be provided to the Client and a link to the Artist’s Trello that allows the client to check progress on Commissions.

Specific deadlines should be indicated in the Commission Form if the Client needs the artwork at a specific time.

1.) After the Client successfully sends the commission form and payment, the Artist will send an email confirming the commission.

2.) The Artist will then send photo(s) of sketches to the Client via email. During this, the Client may ask for changes within reason*.

3.) When the Client is satisfied with the sketch, the Artist will then proceed to line art and color. Then the Artist will show the progress. During this, the Client may ask for changes within reason*.

4.) After this, the Artist will add shading and finishing touches, then show the progress to the Client. At this stage, the Client may request any final changes within reason*.

5.) After all these processes have been done, all other changes will be charged. (See Definitions Section, Number 6)

PAYMENT

Payment shall be made through PayPal (International) or Paymaya (Local).

The currencies accepted are Philippine Peso (₱) and USD ($).

The payment must be upfront or half before the commission is started.

COPYRIGHT

The Artist holds every right to the produced artwork, not the Client.

The following is considered Copyright Infringement:

a.) Distribution and or reproduction of the copyrighted artwork commercially.

b.) Taking credit for the artwork.

c.) Removing any watermarks/signatures.

d.) Altering the artwork without the Artist's consent.

USAGE POLICY

The Client is obligated to use the commissioned artwork for personal use only unless otherwise stated in the commission form.

The Client may claim the right to their character(s), but not the artwork itself.

The Client may use the artwork to promote themselves with the proper credit to the Artist.

The Client is not permitted any misuse of the commissioned work which would reflect discredit on the Artist’s reputation.

CANCELLATION AND REFUNDING

Any violation of these Terms of Service, poor communication, and any rude/inappropriate behavior gives the artist the right to refuse any commissions from the Client.

As of now, refunding is not possible once the payment has been made.

MODIFICATIONS

The Artist may alter and or adjust these Terms of Service at any time without notice. By requesting a Commission, you are agreeing to the latest and current public version of the Terms of Service.

*Additional Characters for any Commission Type would have an extra charge of $5 for each additional character.
